These Terms of Service ("Terms") govern your access to and use of the website https://shminvestmentsgroup.site and any investment and wealth management services provided by SHM Investments Group Pty Ltd (ABN 51 702 578 621) ("we", "us", "our"). By using this website or engaging our services, you agree to be bound by these Terms. If you do not agree, please discontinue use of this website.

All enquiries, notices and formal communications must be directed to us by email at ceo@shminvestmentsgroup.site. We are based in Perth, Western Australia, and provide services to clients across the Perth metropolitan area and greater Western Australia.

We provide investment and wealth management services, which may include portfolio strategy discussion, investment planning support, wealth structuring guidance and ongoing portfolio reviews. The exact scope of services for each client is set out in the individual engagement documents, proposals or statements of work agreed between you and us.

Nothing on this website constitutes an offer to provide services. A binding engagement arises only when both parties have agreed in writing (including by email) to the scope, fees and terms of that engagement.

Quotes and proposals provided by us are valid for 30 days from the date of issue unless otherwise stated in writing. A quote is indicative until the scope of work has been confirmed. We reserve the right to decline or withdraw any quote, or to revise a quote, where the scope of work changes materially or where information provided to us proves to be inaccurate.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including guarantees that services will be rendered with due care and skill and will be reasonably fit for purpose. These Terms must be read subject to those non-excludable rights.

14. Termination and Suspension

Either party may terminate an engagement in accordance with the notice period set out in the applicable engagement documents, or immediately where the other party commits a material breach that remains unremedied 14 days after written notice. Upon termination, you remain liable for all fees and disbursements incurred up to the date of termination.

15. Force Majeure

We are not liable for any delay or failure to perform our obligations where that delay or failure is caused by events beyond our reasonable control, including natural disasters, pandemic, industrial action, cyber incidents, failure of utilities or changes in law.

16. Amendments to These Terms

We may update these Terms from time to time. The current version will always be published on this page with a revised "Last updated" date. Continued use of this website or our services after changes take effect constitutes acceptance of the updated Terms. Material changes affecting active engagements will be communicated to affected clients in writing.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. The parties submit to the exclusive jurisdiction of the courts of Western Australia and any courts competent to hear appeals from those courts.

If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any signed engagement documents, constitute the entire agreement between you and SHM Investments Group Pty Ltd regarding the subject matter, and supersede all prior discussions, representations or agreements, whether written or oral.
